The Association is a non-profit organisation that rescues, cares for and protects animals and helps them find suitable families.
These Terms and Conditions set out the general rules for using the website and the features available through it.
1. Definitions
In this document:
- “Association” means ASOCIAȚIA HAPPY TAILS TIMIȘOARA – CODIȚE FERICITE;
- “Website” means the website available at www.happytailstimisoara.com;
- “User” means any person who accesses or uses the Website;
- “Donor” means an individual or legal entity that voluntarily gives money or goods to support the Association's activities.
2. Purpose of the Website
The Website is mainly used for:
- presenting animals available for adoption;
- informing the public about the Association's activities and projects;
- receiving adoption applications;
- presenting ways to support the Association;
- facilitating donations;
- presenting opportunities for volunteering and involvement;
- providing information about sponsorships and redirecting a portion of tax;
- communicating with supporters and the community.
The Website is not, in itself, an online store and its main purpose is not to sell products or services to consumers.
3. Use of the Website
Users agree to use the Website lawfully and in good faith.
In particular, the following are prohibited:
- using the Website for illegal purposes;
- attempting unauthorised access to the Website's technical infrastructure or the Association's accounts;
- intentionally disrupting the operation of the Website;
- introducing or transmitting content that is illegal, abusive, discriminatory, threatening or infringes the rights of others;
- abusive automated use of the Website's forms or features.
The Association may restrict access to certain features when necessary for Website security or to prevent abusive use.
4. Information published on the Website
The Association makes efforts to keep published information accurate and up to date.
However, some information can change quickly, especially information about:
- the availability of animals for adoption;
- an animal's medical condition or circumstances;
- ongoing campaigns;
- events;
- the Association's needs;
- donation methods;
- tax information relating to sponsorships or tax redirection.
If information on the Website differs from the current situation, Users are encouraged to contact the Association for confirmation.
5. Adoptions
Information about animals presented on the Website is for informational purposes.
An animal shown as available for adoption is not guaranteed to remain available when an application is submitted.
Submitting an adoption form:
- does not constitute an adoption contract;
- does not automatically create a right to adopt the animal;
- does not oblige the Association to approve the application.
The Association assesses each application with the animal's interests and welfare as its primary consideration.
During the adoption process, the Association may request additional information and speak with the interested person to check whether the environment and conditions offered are suitable for the animal.
If an adoption is approved, its specific terms are established in a separate adoption contract between the parties.
The adoption contract, rather than the general information published on the Website, sets out the adopter's and the Association's specific rights and obligations.
6. Donations
Users can support the Association's activities through the donation methods presented on the Website.
Donations are voluntary contributions that support the Association's non-profit activities.
Depending on needs, funds received may be used for activities such as:
- food and supplies for animals;
- veterinary consultations and treatments;
- medicines;
- vaccinations;
- sterilisations;
- microchipping;
- tests and investigations;
- surgery;
- transport;
- accommodation and upkeep;
- animal rehabilitation;
- preparing and supporting adoptions;
- expenses necessary for the Association's operation and activities;
- other expenses consistent with the Association's purpose and objectives.
7. Donations for specific cases
At times, the Association may raise funds for a particular animal, treatment, procedure or other specific case.
If:
- the required amount has been fully raised;
- the treatment or procedure is no longer necessary;
- the animal's situation changes;
- funds remain after the case has been resolved;
the Association may use the remaining funds for other animals in its care, urgent cases or other activities consistent with its purpose, unless a different mandatory use has been expressly established.
8. Donation methods
Donations may be made using the methods indicated on the Website, including:
- bank transfer;
- PayPal;
- card payment through Global Payments / GP webpay;
- other payment methods displayed on the Website.
Card payments are processed by Global Payments / GP webpay, in accordance with the conditions applicable to that payment service.
The Association does not store full bank card details. The data needed to authorise and process a payment is handled through the payment processor's infrastructure.
The payment service provider's own rules and conditions may apply to the transaction.
9. Donations through PayPal
Donations made through PayPal are processed using PayPal's services.
Donors may be redirected to PayPal's infrastructure, whose use is also subject to PayPal's own terms and policies.
The Association may receive from PayPal the transaction information needed to identify and record the donation, depending on the information provided by the donor and the service used.
10. Card donations and recurring donations
Card donations are processed through Global Payments / GP webpay.
Depending on the options available on the Website, donors may make:
- one-time donations;
- recurring donations.
For a recurring donation, the donor authorises periodic processing of the selected amount at the frequency indicated when making the donation.
The Association does not store full card details; they are processed through the Global Payments / GP webpay infrastructure.
The Association may receive transaction information necessary to administer the donation and maintain financial and accounting records, without receiving or storing the full details of the card used.
Donors may request that a recurring donation be stopped using the methods provided by the payment processor and/or by contacting the Association at:
Stopping a recurring donation affects future payments and does not affect donations already processed before cancellation.
In the event of processing errors, duplicate transactions, unauthorised payments or other payment-related problems, donors are asked to contact the Association and, where appropriate, the payment service provider.
11. Refunds of donations
Donations are made voluntarily and, in principle, are not refundable simply because a donor changes their mind.
This does not prevent consideration of situations such as:
- a payment made by mistake;
- a duplicate charge;
- an incorrectly entered amount;
- an unauthorised transaction;
- a technical error;
- other cases where a refund is required by law or the payment processor's rules, or is accepted by the Association in the circumstances.
In such cases, the donor may contact the Association as soon as possible at:
Whether and how a refund can be made may also depend on the service used to make the payment.
12. Donations of goods
Depending on its needs, the Association may accept donations in kind, including food, animal supplies and other goods useful for its activities.
Acceptance of particular goods may depend on their condition, the Association's needs and whether they can actually be used.
The Association may refuse goods that:
- are damaged or unfit for use;
- cannot be used safely;
- involve disproportionate storage or handling costs;
- are not useful for the Association's activities.
13. Sponsorships
Legal entities may support the Association through sponsorships under applicable law.
Sponsorships are made under the relevant contracts and the terms agreed between the parties.
Information on the Website about the tax treatment of sponsorships is general and informational.
